The Prop 8 Decision picked apart

Propostition 8 stands, but the marriages also stand.
This was the only position the judges could really take.
1) It avoids the "Activist Judges Overturning the Will of the People" shouts from right-wing hatespeech radio.
2) It doesn't create an ex post facto situation.
3) It avoids large-scale violence. The gay community is about 3-5% of the US population. And their enemies also tend to be better armed. There is a large, vocal minority in this country who would dearly love to see gays eradicated and are willing to help. I expect to see a rise in hate-crimes.
The gay community is--rightly--unhappy. But, we'll take it back to the ballot box and this time, we'll win.
The Christian Right is also unhappy. They didn't get what they see as sodomite "marriages" wiped out. They haven't been able to force shame on the community. They know they are losing.
Of course, nothing says the gay community can't introduce referendums to put other minority groups' civil rights to a majority vote. (I'm looking at the Mormons) You know, just to make a point...
